1. Service Operator

The service is operated by an individual entrepreneur using the trade name FileConvertLab.

Operated from Switzerland. Applicable law: Swiss law.

In accordance with Swiss law for individually operated online services that do not process sensitive categories of personal data, no personal name or physical address is required to be published.

2. Services

The website provides online document-conversion tools, file-processing functionality, and productivity-related features. The operator may update or modify the features at any time.

3. Acceptance of Terms

By accessing or using the service, the user agrees to these Terms & Conditions. Users who do not agree must discontinue use.

4. User Obligations

Users agree to:

  • comply with applicable laws;
  • not attempt unauthorized access, disruption, or abuse of the service;
  • not upload illegal, harmful, or infringing content;
  • not use the service for spam, fraud, or malware distribution;
  • respect third-party intellectual property rights.

5. Accounts and Payments

  • Users must provide accurate account information.
  • Pricing and billing terms are displayed on the site.
  • Failed payments may lead to suspension.
  • Subscriptions automatically renew unless canceled before the renewal date.

Refund Policy:

All purchases are final. The operator does not provide refunds except where required by mandatory applicable law or where otherwise explicitly communicated in writing. Cancellation of a subscription will take effect from the next billing period; no refunds or credits will be issued for partial billing periods or unused portions of the service.

If a service is discontinued entirely by the operator, a pro-rata refund for prepaid unused fees may be provided at the operator's sole discretion.

6. API Usage

The following terms apply to programmatic access via the FileConvertLab API:

  • API Keys: API keys are personal credentials. Users are solely responsible for maintaining the confidentiality of their API keys and for all activities that occur under their keys. Sharing API keys with third parties is prohibited.
  • Rate Limits: API access is subject to rate limits based on the user's subscription tier. Exceeding rate limits will result in temporary rejection of requests (HTTP 429). Repeated or intentional abuse of rate limits may result in suspension.
  • Automated Access: Programmatic access to the service is permitted only through the official API using valid API keys. Scraping, reverse engineering, or bypassing API authentication is prohibited.
  • Commercial Use: API access may be used for commercial purposes within the limits of the user's subscription tier. Reselling API access or building competing services is prohibited.
  • No Service Level Agreement: The API is provided without uptime guarantees. The operator may modify, suspend, or discontinue API features at any time without notice.
  • Quota Attribution: All API usage is attributed to the API key owner. Users are responsible for any usage made with their keys, including unauthorized use resulting from compromised credentials.

7. File Processing

Uploaded files are processed automatically to deliver the requested service. By uploading files, users grant the operator the right to process, store, and use the files and metadata as described in the Privacy Policy. Users retain ownership of their original content, but the operator may retain processed data in accordance with operational and legal requirements.

The operator collects and retains service usage data and operational metrics. This data may be aggregated and shared with third parties as described in the Privacy Policy.

8. Intellectual Property

All content, software, and materials are owned by the operator under the FileConvertLab trade name unless stated otherwise. Users receive a limited license to use the service as intended.

9. Service Disclaimer and Limitation of Liability

Service Provided "As Is":

The service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The operator expressly disclaims all warranties of any kind.

No Quality Guarantees:

The operator does not guarantee the quality, accuracy, completeness, reliability, or availability of the service. File conversion results may vary depending on the source file format, complexity, and other factors. The operator makes no representations that conversion outputs will meet user expectations, preserve formatting, or be suitable for any particular purpose. Users are solely responsible for verifying conversion results before use.

No Support Obligations:

The operator is under no obligation to provide customer support, technical assistance, or troubleshooting services. Any support provided is offered voluntarily and at the operator's sole discretion. Response times, availability, and scope of support are not guaranteed. The operator reserves the right to limit, suspend, or discontinue support services at any time without notice.

To the maximum extent permitted by applicable law, the operator is not liable for:

  • data loss, corruption, or unauthorized access;
  • service interruptions, errors, bugs, or malfunctions;
  • indirect, incidental, consequential, or punitive damages;
  • loss of profits, revenue, or business opportunities;
  • any use or misuse of converted files or documents, including unlawful use by users;
  • issues arising from third-party links, integrations, or services.

Users are solely responsible for the legality and appropriateness of the content they upload and how they use processed files.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

10. External Links

Third-party links are provided for convenience. The operator is not responsible for their content or policies.

11. Termination and Suspension

The operator reserves the right to suspend or terminate user access to the service at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to:

  • violation of these Terms & Conditions;
  • abusive or fraudulent behavior;
  • suspected illegal activity;
  • non-payment of fees;
  • at the operator's sole discretion for any reason.

Upon termination, user data may be retained or deleted at the operator's discretion in accordance with Section 4 of the Privacy Policy.

12. Changes to Terms & Conditions

The operator reserves the right to modify these Terms & Conditions at any time without prior notice. Updates will be posted on this page.

Continued use of the service after changes constitutes acceptance of the updated Terms & Conditions. Users who do not agree with changes must discontinue use of the service.

13. Applicable Law and Jurisdiction

These Terms & Conditions are governed exclusively by the substantive laws of Switzerland, excluding its conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG).

Any disputes arising from or relating to these Terms & Conditions or the use of the service shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland.

For EU consumers: This choice of law and jurisdiction does not deprive EU consumers of the protection afforded by mandatory provisions of consumer protection law in their country of residence, where such provisions cannot be derogated from by agreement.

14. Dispute Resolution

The operator is not obligated to participate in alternative dispute resolution procedures. Users agree to attempt to resolve disputes amicably before pursuing legal action.

15. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms & Conditions, together with the Privacy Policy, constitute the entire agreement between the user and the operator regarding the use of the service.
